Terms and Conditions of Sale

Please read these terms and conditions carefully as they affect your rights and liabilities under the law and set out the terms under which Dunnet Bay Distillery Ltd (“we”) makes its products available to you. We are registered in Scotland under company number SC454474 with our registered office at Ribbon House, Dunnet, Thurso, Caithness, KW14 8YD.

All orders for goods placed by you via the online order form shall be deemed to be an offer by you, the buyer, to purchase goods pursuant to these terms and conditions. You, the buyer, shall be responsible for ensuring the accuracy of the details provided in your order and we will not be obliged to accept an order unless all details requested have been provided correctly.

You must be aged at least 18 years to purchase from Dunnet Bay Distillers Ltd. In the UK it is illegal for any person under the age of 18 to buy, or attempt to buy, alcohol for themselves or for any other person under the age of 18.

Prices

All prices are shown in GBP (British Pound). The total price we charge you for the goods in your order includes all applicable taxes payable in the UK. Prices shown on the Website for any products or services offered are subject to change without notice. Any price changes will be notified and confirmed to you before despatch to give you the opportunity to cancel your order.

Prices shown for products on the Website are not inclusive of delivery charge. You will be advised of the cost of delivery on the Website at the time your order is accepted. If your order is over £50.00, don’t forget to select the box for FREE DELIVERY at check-out so you don’t get charged for delivery.

Dunnet Bay Distillers Ltd reserves the right to alter the prices of the goods on offer online at any time without prior notice.

Availability

All products offered are subject to availability and we cannot guarantee availability of the products listed.

If we are unable to fulfil your order we will contact you within 3 working days of receiving your order.

Acceptance

As all products and services are subject to availability, there will be no contract of any kind between you and us unless and until we actually process and despatch the goods to you. At any point up until then, we may decline to supply the goods to you without giving any reason.

Payment

We use Paypal or Stripe to accept payments allowing you to use your bank account, credit/debit card or your Paypal balance.
Your payment details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. You will be automatically charged for your order once your payment details have been accepted. Our liability to you in connection with any order will not exceed the total price charged for the relevant items.

Delivery

All deliveries are sent by courier. We can deliver to your home or work address, as you have entered it on the order. We cannot accept any liability if quoted address is incorrect or incomplete. Deliveries to work addresses shall be deemed successful if a representative at that address accepts and signs for the goods.

We will always do our best to fulfil your order as quickly as possible. If your order is time specific please do contact us prior to ordering. We might experience delays due to high order numbers particularly around Christmas, if we are aware of any delays we will endeavour to let you know. If goods fail to arrive after 28 days from date of order, please notify us on in**@du*****************.uk. We do our best to secure delivery within 28 days of the date of your order, but shall not be liable for loss occasioned by delay in delivery arising out of any cause beyond our control.

UK orders will normally be delivered within 3 days of despatch.

In the event that the order is returned to us by the courier or otherwise due to non-delivery, Dunnet Bay Distillers Ltd gives the purchaser the option of resending the purchase at the purchaser’s expense or refunding the purchase less the cost of postage and packing. We cannot deliver to PO boxes.

Returns & Refunds

We hope you will be happy with your purchase. When you get your package please check carefully and notify us, within 2 days, if you have the wrong item, or if it has been damaged. If goods are damaged you should contact us straight away on in**@du*****************.uk.

Purchasers may cancel the order by informing Dunnet Bay Distillers Ltd within 7 days of receiving their order. Please return it to us unopened, sealed and in original condition and within 7 days of the date cancelled, for a refund. All shipping back to us is paid by the customer, and we are unable to refund you for your postal fees.

We are not able to refund any import duties, taxes or administration fees incurred in connection with the delivery or return of the Product.

Liability for loss or damage during the return transit is also the responsibility of the purchaser.

Dunnet Bay Distillers Ltd will refund the purchase within 30 days of you notifying us about the return, to the credit/debit card or Paypal account used to make the purchase.

Refill Rewards Club

1. Membership

By purchasing a Refill Rewards Club Membership, you acknowledge that your Membership has an initial and recurring payment feature and you accept responsibility for all recurring charges as covered in our FAQ.

We reserve the right to make changes to the plan, within reason. Any price changes will be notified and confirmed to you before despatch to give you the opportunity to cancel your order.

2. Price

All prices are shown in GBP (British Pound). The total price we charge you for the goods in your order includes all applicable taxes payable in the UK. Prices shown on the Website for any products or services offered are subject to change without notice. Any price changes will be notified and confirmed to you before despatch to give you the opportunity to cancel your order.

Your recurring payment will be taken on the 1st of the month that you are due a box depending on the frequency you desire (monthly, bi-monthly or quarterly). You can check your account to see when the next payment will be taken.

Please note a higher charge is applicable for a Navy Strength pouch which is shown on the product page.

3. Delivery

We will dispatch each month’s box during the first week of the month. All deliveries are sent by courier. We can deliver to your home or work address, as you have entered it on the parent order. We cannot accept any liability if quoted address is incorrect or incomplete. Deliveries to work addresses shall be deemed successful if a representative at that address accepts and signs for the goods.

We will always do our best to fulfil your order as quickly as possible. 4. Changes to membership

You can change (upgrade, downgrade) your membership subscription at any time from your account page. Pouch Editions may be switched at any time by logging into your account page. Any changes made to pouch edition will be shown immediately on your account. Any changes to frequency may not be displayed until the end of the month.

5. Cancellation

You can cancel at any time from your account page. Any Membership cancellations need to be done before the 1st of the next month that you are due a box. There is also the option to pause your account at any time. This may be done through your account.

Refill Rewards Gift Certificate Terms & Conditions

By purchasing a Refill Rewards Club Gift Certificate for a gift recipient, you acknowledge that the Refill Rewards Gift Certificate cannot be cancelled. Each Refill Rewards Gift Certificate is taken as a one-off payment at the time of purchase. This is not refundable.

  • £99 = 3 boxes including delivery – 1 per month for 3 months
  • £198 = 6 boxes including delivery – 1 per month for 6 months
  • £396 = 12 boxes including delivery – 1 per month for 12 months

 

The first box will arrive in the first week of the month after the recipient has signed up using the code on the gift certificate. If your gift recipient orders after the first of the month, the box will arrive the following month as stipulated in the FAQ.

Gift Vouchers

Gift vouchers are non-refundable and can be redeemed here on www.dunnetbaydistillers.co.uk or in our distillery shop.

The voucher code is valid until fully redeemed within the expiry date, two years from the date of purchase.

If you don’t use all of your gift voucher balance at one time, you can use your voucher code for future transactions.

The gift voucher recipient must be aged 18 years or over. Gift vouchers cannot be issued for children.

Loyalty Points Programme

The Programme is a way in which we reward and thank our loyal customers for purchasing our products. You are able to earn points by making eligible purchases or taking certain other actions as specified by us. For your purchase to qualify for loyalty points, you must be signed into your account at the time of purchase. Once you reach a certain number of points, you may be eligible for certain rewards.

1. Membership

1.1 You may enrol in the Programme LOYALTY POINTS PROGRAMME by visiting www.dunnetbaydistillers.co.uk and creating an account by following the Loyalty Programme prompts. If you are already hold an account on www.dunnetbaydistillers.co.uk you will already be registered and eligible to start receiving loyalty points.

1.2 Membership is offered at the sole discretion of Dunnet Bay Distillers Limited. The Programme is available to individuals for their personal use only and is limited to one account per individual. Corporations, associations or other groups may not participate in the Programme. Individuals must be residents of the United Kingdom and aged 18 years or over. No purchase is necessary to join the Programme. The Programme may not be used for any business or commercial purpose and we may refuse to create an account for any reason.

1.3 The Programme and its benefits are offered at our sole discretion. We reserve the right to change rewards, how you earn points and how we evaluate and reward your eligible purchases and/or other activity. We reserve the right to place limits on the number of purchases or activities that are eligible for loyalty points, the number or types of rewards or benefits you may receive, in a given time period or for the duration of the Programme, and/or any combination thereof. Except where prohibited by applicable law, we may, in our discretion, cancel, modify, restrict or terminate these Terms and/or the Programme or any aspect or feature of the Programme at any time without prior notice, even though such changes may affect the value of rewards or benefits already accumulated or earned and/or the ability to redeem accumulated rewards or benefits.

2. Points & Rewards

2.1 To earn points online, you must be enrolled in the Programme and be signed into your account at the time of purchase. Currently, only purchases made on the Website or at our Distillery Shop are eligible for loyalty points. Purchases made in other outlets are not eligible for loyalty points at this time. If this changes, we will update these Terms. Only orders made after 25th November 2022 are eligible to receive loyalty points.

2.2 Members receive 5 points for every £1 spent on qualifying purchases on the Website. Shipping and delivery charges are excluded. All points are pending until your order ships, at which time they are fully vested and capable of redemption.

2.3 In addition to these purchases, you may also earn points for the following actions on the Website. To earn points, please check to make sure you are logged into your account before completing the actions below. The number of points awarded for each action is determined by Dunnet Bay Distillers in its sole but reasonable discretion and in all cases subject to a maximum number of points earned for each action per year.

  • 50 points when you create an account
  • 1 point per visit to our Website per day
  • 5 points per pound spent on our Website or in our Distillery Shop
  • 5 points per product review. Must be a verified purchase through our Website
  • 5 points when you share our loyalty scheme on social media (once per social media channel)
  • 10 points for placing your first order (one time only)
  • 10 points for joining our Refill Rewards Club (one time only)
  • 10 points when you book a distillery tour
  • 10 points when you purchase a gift voucher
  • 50 points awarded on your birthday (only available if you have opted to share your birthday on your account)
  • 50 points when your referred friend receives their first Refill Rewards Club box
  • 50 points when your referred friend spends £50 or more on their first order

 

2.4 Other opportunities to earn points will be posted on the Website or may be published through other media (e.g., in-store, in marketing communications, social media, etc.)

2.5 You may redeem one reward per transaction on the Website by logging into your account and unlocking the reward from your account page. Rewards are subject to availability and may change from time to time. Please allow 28 days for delivery of rewards, unless otherwise notified by email. Rewards are only redeemable with product purchases. You will find your eligible rewards (with offer codes once redeemed) listed in your account.

2.6 Loyalty points have no cash value and are non-transferable. Rewards cannot be exchanged or returned for points, another product or a monetary refund. Points credited to your account will be decreased or reversed, as applicable, if part or all of a purchase is returned or cancelled or if the credit is obtained through fraudulent or other activity that violates these Terms as determined by us in our sole but reasonable discretion

2.7 Any suspected abuse of the loyalty points, illegal activity, fraud, misrepresentation or other conduct detrimental to us or our interests, may result in the revocation of your membership and make you ineligible for further participation in the Programme. Your account will automatically expire and your access to the Programme and features will automatically terminate, we reserve the right to take appropriate legal action.

2.8 If you have concerns that a purchase or other activity was not applied to your account, you should contact us at in**@du*****************.uk or by calling 01847 851 287 (from within the UK) within 28 days. We are not responsible for late notifications about purchases or other activities not being credited to your account.

3. Cancellation

If you decide you no longer want to collect loyalty points, you may cancel your membership at any time by logging in to your account on the Website and clicking on Cancel Membership which is located at Account Profile to terminate your membership of the Programme at in**@du*****************.uk or 01847 851 287 (from within the UK). If you cancel your account, you will automatically lose all accumulated points and no longer receive Programme related emails.
